Privacy Policy

1. Who we are

This website (livingstonnorthstationapartments.co.uk) is operated by Damola Agbelusi, trading as Livingston North Station Apartments ("we", "us", "our"), of 91 Queens Crescent, Livingston, EH54 8EG, United Kingdom.

For any question about this policy or your personal data, contact:
Email: ooagbelusi@gmail.com
Phone: +44 7853 298533

2. What this policy covers

This policy explains how we collect, use, share and protect personal data when you:

- enquire about or book a stay directly through our website
- book a stay through Airbnb or Booking.com
- stay with us and use our digital guidebook (Touch Stay), including any contact details you give us through it
- otherwise contact us about a reservation

It applies wherever your data reaches us, whether directly, through our booking and property management system (Lodgify), or through an online travel agency (Airbnb, Booking.com).

3. Personal data we collect

Depending on how you interact with us, we may collect:

- your name, email address and phone number
- your postal address, where given (for example on an invoice)
- reservation details: dates, number of guests, property booked, special requests
- payment status relating to your reservation, handled by our payment providers, Stripe and PayPal (see section 6); we do not ourselves receive or store full card details
- messages you send us, for example through our website enquiry form, Touch Stay's chat, or direct email or phone
- if you opt in, your marketing consent status and preferences
- basic website usage data described in section 8 (Cookies)

We do not collect any special category data (such as health information) unless you volunteer it to us, for example to tell us about an accessibility need, in which case we will only use it to prepare for your stay.

4. How we use your personal data, and our lawful basis

- Booking fulfilment: Processing your reservation, confirmations, check-in details, invoicing. Lawful basis: Contract, necessary to perform the booking you made with us.
- Guest communications: Pre-arrival information, our Touch Stay digital guidebook, messages about your stay. Lawful basis: Contract, and legitimate interests where a message falls outside the strict booking (legitimate interest: giving guests a good, well-informed stay).
- Accounting and legal records: Keeping invoice and transaction records. Lawful basis: Legal obligation, UK tax record-keeping rules require us to keep these records.
- Website and security: Keeping our website and booking systems working and secure. Lawful basis: Legitimate interests, keeping our business and our guests' data secure and our systems reliable.
- Direct marketing: Occasional emails about booking with us again directly. Lawful basis: Consent, only where you have actively opted in, see section 7.

5. Where your data comes from

We receive your personal data from one of the following sources, depending on how you book:

- directly, if you enquire or book through our website's booking form or contact form
- from Lodgify, our booking and property management system, which we use to manage all reservations regardless of source
- from Airbnb, if you book your stay through Airbnb
- from Booking.com, if you book your stay through Booking.com
- from you directly, if you provide contact details through Touch Stay's Contact Collection form during your stay

If you book through Airbnb or Booking.com, that platform is also a separate data controller in its own right, and processes your data under its own privacy policy. This policy covers what we do with your data once we receive it, and any data you give us directly.

6. Who we share your data with

We use the following service providers in connection with your booking:

- Lodgify: our booking engine, channel manager and website hosting provider, acting as our processor. Lodgify handles reservation, guest contact and payment-status data on our behalf, and syncs reservations across booking sources.
- Stripe and PayPal: our payment providers for direct bookings made through our website. Stripe and PayPal are not simply processors acting on our instructions; they are independent, regulated payment institutions and act as controllers in their own right for the payment and fraud-screening data they handle. Their own privacy policies apply to that processing: https://stripe.com/gb/privacy and https://www.paypal.com/uk/weba....
- Touch Stay: our digital guidebook and guest communication platform, acting as our processor. Touch Stay stores guest contact details, reservation and booking-source information, and any marketing consent you give us through its Contact Collection feature.
- Cloudflare: provides security and performance monitoring for our website, acting as our processor. This is limited to anonymised technical performance data (see section 8).

Where you book through Airbnb or Booking.com, those platforms also hold and process your data as independent controllers.

We do not sell your personal data, and we do not share it with any third party for their own marketing purposes.

Some of our service providers may process data on servers located outside the United Kingdom. Where this happens, we rely on the safeguards those providers have in place (such as the UK's International Data Transfer Agreement or adequacy regulations) to keep your data protected to UK standards.

7. Marketing emails and your consent

We only send marketing emails, for example occasional offers to book directly with us again, to guests who have actively opted in.

How this works depends on how you booked:

- Airbnb: we do not use Airbnb guest details for direct marketing, and we do not show Airbnb guests the marketing opt-in in our Touch Stay guidebook.
- Booking.com: we do not use the relay contact details Booking.com provides us with for unsolicited marketing. If you independently provide your own contact details through our Touch Stay guidebook and actively opt in to marketing, we may use those independently provided details in accordance with that consent.
- Direct bookings: guests who book directly through our own website may be shown the option to opt in to marketing through our Touch Stay guidebook's Contact Collection form.

You can withdraw your consent to marketing emails at any time, by:

- using the unsubscribe link included in any marketing email we send, or
- emailing ooagbelusi@gmail.com and asking to be removed

Withdrawing marketing consent does not affect any communication we need to send you about an existing or upcoming reservation, which we send regardless of marketing consent as part of delivering your booking.

8. Cookies and similar technologies

Our website is built and hosted on Lodgify's website platform. Based on a direct check of our website's own technical traffic, it currently uses only:

- strictly necessary cookies or similar technology set by Lodgify's booking engine and website platform, needed to operate the booking widget, currency selector and checkout
- an anonymised, cookieless performance-monitoring beacon from Cloudflare, our security and content delivery provider

We do not currently use Google Analytics, Meta (Facebook) Pixel, or any other third-party advertising or analytics tracking on this website, and our Map page uses a static, proxied map image rather than a live embed, so it does not set any Google cookie either.

Because only strictly necessary technology is currently in use, we do not currently display a cookie consent banner, which UK law does not require for strictly necessary cookies. If we add any analytics, advertising or other non-essential technology in future, we will update this section and add a consent banner before doing so.

9. Touch Stay and your digital guidebook

If you stay with us, you will be sent a personalised digital guidebook link through Touch Stay. This may ask you to confirm your name, email and phone number, and, depending on how you booked, may show you the option to opt in to marketing emails (see section 7). Touch Stay stores this information, along with which booking source (Airbnb, Booking.com or direct) your invitation was created for, so that we can tailor what is shown to you appropriately and meet each platform's own rules.

10. How long we keep your data

We keep different categories of data for different lengths of time, based on why we hold them:

- Accounting and tax records (invoices, transaction amounts): Retained for at least the period required by HMRC, currently at least five years after the relevant Self Assessment filing deadline. Why: UK tax record-keeping requirement.
- Guest operational contact details and stay-related messages: 24 months after checkout. Why: Proportionate window to handle post-stay queries, damage claims or disputes, then deleted.
- Marketing contact details: Until you withdraw consent, or 24 months of no engagement with our emails, whichever is sooner. Why: We do not hold marketing data indefinitely once it is stale.
- Enquiries that did not result in a booking: 12 months from the enquiry. Why: No ongoing relationship or contractual need beyond following up once.

11. Your rights

Under UK data protection law, you have the right to:

- ask us for a copy of the personal data we hold about you
- ask us to correct inaccurate or incomplete data
- ask us to delete your data, in some circumstances
- ask us to restrict how we use your data, in some circumstances
- object to us using your data for certain purposes, including direct marketing
- ask us to provide your data to you, or transfer it to another organisation, in a portable format
- withdraw consent at any time, where we rely on consent (marketing emails)

To exercise any of these rights, contact us using the details in section 1. We will respond within one month.

12. Complaints

If you are unhappy with how we have handled your personal data, please contact us first so we can try to put things right. You also have the right to complain to the UK's data protection regulator:

Information Commissioner's Office (ICO)
Website: ico.org.uk
Telephone: 0303 123 1113

13. Changes to this policy

We may update this policy from time to time, for example if we start using a new service provider or technology. The "last updated" date at the top of this page will always show when it was last changed.
